This point makes sense because research revealed how adolescent brain functioning differs from that of adults which affects behavior and the decision-making processes. Professor Elizabeth Scott, from Columbia Law School, explored the Criminal Justice and the Juvenile Brain in 2013. She stated, “the idea is, because of their immature brains, adolescents may be more likely to engage and reckless and sensation-seeking behavior and to get involved in criminal activity”. Her research is already having a huge impact on law and policy. However, I believe juveniles understand that committing murder is a crime and if caught they know they will face the consequences of their actions. However, the scientific study regarding brain functioning could differ due to an underling mental disorder in both juveniles and

Consequently, they are more prone to risk taking and peer influence than adults; they think less about their future and express their emotions in more volatile ways. The juvenile system recognizes this distinct adolescent nature, and allows for recovery through developmentally appropriate programs, making young adults under eighteen better suited for the juvenile system rather than the adult system. However, when young law-breakers murder or rape someone, it is much more difficult call on whether they should be tried as adults or juveniles. The decision should be made on a case-by-case basis, depending on the severity, motive, and nature of the crimes. For example, a sixteen-year-old boy murdering his father to protect his sister warrants a different analysis than a case of a remorseless sixteen-year-old boy who murdered a mother and her two young children to steal a car.…

The article, “Juveniles Should Be Tried As Adults” by Mary Estudillo, brings up many strong arguments as to why juveniles should be tried as adults, but the opposing article, “Juveniles Should Not Be Tried As Adults” written by Hannah McCrea strongly claims they should not. Estudillo cites examples of cases in which juveniles committed first and second degree murder, and were thereafter tried as adults. She explains how juveniles should be tried as adults because they are criminals, and criminals need to held responsible for their actions. She also brings up how rehabilitation does little to sometimes nothing for the child, so when they are released, they commit another crime. Alternatively, McCrea authored “Juveniles Should Not Be Tried As Adults,” and states how adult prisons do more harm than good for juveniles.…

Several juvenile defenders will argue that not all minors have a reason to commit a crime. They can argue that in Jenkins 's article, "On Punishment and Teen Killers," she mentions that a teenager murdered her pregnant sister and her husband for the "thrill to kill," as Jenkins describes it (Jenkins 91). They will argue that adults dont murder for the "thrill to kill," and that some juveniles do it without targeting anyone specifically. They might not have a reason to why they committed a crime, but they murder because they have the available resources. However, some adults are actually capable of murdering in large amounts with no reason.…

The idea that teens should or should not be tried as adults, if they commit a felony has “stirred much opposition and controversy” over the years (Estudillo 3). Roksana Sikorski, slit her brother’s throat and he woke their parents and their younger sister up with his screams. Michael Riveria was sitting outside their home, texting Roksana instructions. When it comes to the criminal justice system, there are many varying elements that contribute to the process through which accused offenders are counseled. As is expected, there are also numerous moral and ethical disputes that come with the territory, such as whether or not children, or 'juveniles', should be tried as adults in court for the violent crimes they commit. Some may say any child over the age of five should know the difference between right and wrong; for an individual to plan out a crime and act on it, the punishment should fit the offense, no matter the age. However, there is a thin line between vice and neurosis when it comes to juveniles. The incarceration of individuals under the age of sixteen at adult correctional facilities…
