So if you can’t see a MARN number on their website and you cannot find them on the MARA website register don't use them!

Offshore agents – immigration advisers outside of Australia

Whilst the MARA website is an excellent tool for applicants to check whether the company or individual they are dealing with is registered, there is sadly a shortfall when it comes to 'agents' outside of Australia.

If the company or individual is outside of Australia they do not need to be registered. There is little doubt that this non requirement is responsible for most of the rogue elements that exist in the Australian Immigration Industry.

In short it means anyone can give you advice and take your money – there is no need for them to undertake qualifications, prove experience, undertake continuing professional development and importantly be held accountable for their actions.

What they will tell you when you contact them

The classic reply is that they do not need to be registered, and whilst this is true it should immediately through up alarm signals to you. You will be parting with your money without the benefit

It was stated on many occasions from the Minister for Immigration and Multicultural and Indigenous Affairs that in the context of unauthorised boat arrivals that Australia, as a sovereign country, has the right to defend the integrity of its borders. Australian courts have also confirmed Australia’s right to determine who does enter or remain in Australia and who does not (Human Rights, 2015). The Department of Immigration and Border Protection completes the primary assessment as to whether a person is a refugee as per definition given in the Migration Act (Human Rights, 2015).
