The Equal Pay Right of 1963 is based on the prohibition of sex discrimination. No employer should be paid less rate based on the opposite sex. However, this was an issue where the opposite sex was making minimum wage. The Equal Pay Right occurs that the opposite sex should be paid the same because they are qualified to do same job task which stands for, “requires equal skills, effort, and responsibility, and which are performed under similar working conditions, except where such payment is made pursuant to (i) a seniority system; (ii) a merit system; (iii) a system which measures earnings by quantity or quality of production; or (iv) a differential based on any other factor other than sex (EEOC website).” Therefore, this provides any employee who is receiving a pay wage rate differential is a violation and shall not occur, for this subsection does not occur companies to complying in reduces the pay rate of any …show more content…
For example, Lilly Ledbetter, who work Goodyear was receiving unequal pay for decades now until an anonymous note. Terri Kelly, who is a pharmaceutical sales representative who discovered her unequal pay from her husband. He has the same exact job experience and skill set as his wife, but he was paid thousands of dollars more than Terri. In these two cases, we know that unequal pay still exists today and continue to happen to women across America.
This issue goes back to companies who do not address the company policy which is a lack of accountability allowing employees to get under pay. Businesses can ban the pay secrecy policy which allows better way for employees to have the same pay rate and wages. The Paycheck Fairness Act is the same procedural of Equal Pay Act and Fair Labor Standards Act help addressed the gender pay gap in America to become law.
