The purpose of this memo is to describe how to identify federal statute and individual state regulations, that are defined to identify English Learners under the requirements of ESSA. Further, this memo will locate any potentially unclear elements and questions that remain to be answered, regarding ESSA, Sec. 3003. English language acquisition, language enhancement, and academic achievement.
To locate the federal ESSA statute, also known as Public Law 114-95 online, first conduct a web search for ESSA. Based on the search results, the U.S. Department of Education, ESSA link can be accessed, where Public Law 114-95 (ESSA) is named. Using the ESSA Public Law number, the act can be easily located on the cogress.gov website, in its entirety. Using the Table of Contents of the Act, Part F – General Provisions contains requirements of Title III and more specifically, Sec. 3003. To locate a state-specific ESSA plan, conduct a web search containing the name of the state, and state “approved ESSA plan,” then the direct link to the source will populate. For the purposes of this memo, New Mexico’s ESSA plan will be reviewed. Locating the state regulation that is aligned to the federal statute, in this case, was easy due to the direct naming
