The employee selection process is the first of many critical steps a business faces when growing its employee base. It is during the interview process that the prospective employee’s talent, attitude, background, and experience can be determined. In order to do this successfully and without putting the company at risk the interviewing committee or person(s) must understand and adhere to the law. It is critical that during the interview process one does not ask questions related to Nationality, Religion, Age, Martial and Family status, Gender, and Health and Physical Abilities (30 Interview Questions You Can 't Ask and 30 Legal Alternatives, 2013), these questions violate a person’s rights according to the United States Equal Employment Opportunity Commission (U.S. Equal Employment Opportunity Commission, 2015).
As described in an “In the News” article, Employment Law Ch. 2, the Employment Scenario Section to the Discrimination in Promotions section, one can see where asking an interviewee their race can lead to a law suit be filed. Frank Davis an Afro-American employee was working as the first assistant director on the film 2 Fast 2 Furious, Frank is later terminated, the article does not explain why the termination took place, only that after his release he files a discrimination act against the studios production manager for a question that had been asked in an interview related to the second assistant directors…
