Some of you may be aware of the Administrator’s Interpretation 2015-1 issued by the Department of Labor Wage and Hour Division. The purpose of this memo was to provide employers and employees a clear explanation of what distinguishes an employer and an independent contractor. The DOL has become concerned of the misclassification of employees as independent contractors. According to the Department of labor, misclassification “presents one of the most serious issues facing workers, employers, and the entire economy” .
