There was high turnover of the staff and the residents were left unattended for longer hours which could be the reason for fall and bruises. Moreover, the residents did not have shower or bath for more than two to three days. This resulted in distress and worse skin condition among the residents. These are the signs of neglect. Besides, the reasons for bruises does not seem to be recorded. In addition, if we are thinking about worst case scenario, the staff were working in the stressful situation so they may have taken out the stress on the residents. They are overloaded with more tasks than they are meant to perform because of which they are unable to meet their own duty of care. This possess the physical as well as mental health risks to the employees. If we have to work in the environment like Maryvale, then we are obvious to have stress and tension. The poor management who is overloading the staffs with extra jobs than stated in the contract is a type of exploitation. Furthermore, the poor hygiene in the work place due to the lack of cleaners puts the employees as well as the residents in the health risks. The health and safety of residents as well as employees is neglected by the management. The Health and Safety at Work Act 1974 (HASAWA) states that the employer should do risk assessment in order to minimize or avoid the health hazards in the work place for the protection of employees, service users and visitors from occupational diseases and illness. However, Maryvale lacks enough staff, has poor environment and sanitation, and has poor implication of safeguarding and infection prevention. This possess health risks for both staffs and residents. Therefore, we can say that the Maryvale is unable to protect its staff as well as the residents and is violating the Health and Safety at Work Act 1974 (HASAWA).

Therefore, bearing this in mind the management in Maryvale should hire the carers as well as cleaners. If the cleaners are hired, the carers do not have to share the domestic duties, thus they can pay more attention to the residents leading to the limited number of fall and injuries. Furthermore, the residents need not wait for long or manage themselves for the personal care. This helps to improve the skin conditions and cleanliness of the residents. Since, residents are attended on regular basis and their needs are prioritized, they will not feel distress. This help to improve the quality of care.
