Discrimination In Eliza's Essay

Eliza has brought a claim against the ISP alleging that she is a victim of discrimination under Title VII of the Civil Rights Act. The basses of Eliza’s claim comes from the fact that the ISP refused to offer her light duty work after she informed them that she was pregnant. In order to prove that one was discriminated against under Title VII of the Civil Rights Act, one has to establish the prima facies elements which were set up in McDonnell Douglas Corp. v. Green, 411 U.S. 792, 93 S.Ct. 1817, 36 L.Ed.2d 668 (1973). These elements include: showing that one was part of a protected class, one performed their occupation in a satisfactory manner, one suffered an adverse action, and other members outside of their class were treated differently. In this case, the ISP stated in a 2014 evaluation, that the reason they were unable to grant Eliza a promotion, was because her writing skills remained poor. (C. 32). However, although it is true that she has made grammar mistakes in the past, her supervisors have only mentioned her grammar mistakes in her 2010 and 2011 evaluation. (C. 21) Furthermore, in these evaluations, Eliza’s supervisors have rated her overall performance as satisfactory to above satisfactory. (C. 21) In addition, during the six years that Eliza worked for the ISP she never receive a disciplinary write up for having poor grammar skills. Additionally, from 2011 till 2014 Eliza did not receive any criticism about her writing from her superiors Moreover, in her 2012 evaluation, her supervisor even reported that her writing has improved. (C. 10). Because she has only received one disciplinary write-up, and since her writing has improved, it is clear that Eliza performed her job in a satisfactory
