Eeoc's Lawsuit Case Study

This case was based upon Swissport Fueling to pay $250,000 to settle EEOC race and national Origin harassment Lawsuit. The African fuelers who were at the Phoenix airport were repeatedly called and referred to as “Monkeys” by swissport manager. Out of spite and anger the manager subjected the African people as monkeys by meaning “what were they doing there as if they did not belong. This harmfully affected those African people who were from nations such as Sudan, Nigeria, Ghana and Sierra Leone. Those degrading terms the manager from the Phoenix Sky Harbor Airport used was much uncalled for. Which is why the EEOC’s lawsuit was brought in so that those African fuelers could have some type of relief. This after the African fuelers took the initiative in reporting the harassment first verbally and in writing. They did so by signing a written petition explaining the incident thoroughly and delivered it to …show more content…
Well first discrimination was violated simply because the manager was being hostile by calling the Africans at the airport monkeys. Clearly they were not monkeys but in fact people of color who did not deserve to be degraded with a derogatory term. Moving forward the manager also broke the law under harassment which he then continues to call them as monkeys in a work environment which was also uncalled for as well. In result the EEOC was involved due to the actions of those violated by the manager’s hostile remarks which ended in the settlement of $250,000.
What actions should the employer have taken to avoid illegal discrimination? First if there really was a problem where the manager had with the Africans at any time he could have called someone higher up and expressed those issues. Instead he took it upon himself to use derogatory terms to embrace a group of individuals who are as equal as himself. This was the main mistake made at hand, and for future references it is probably best if the employer does not say anything at
