I told him he did not have to speak with law enforcement, but several subjects had approached me and said he had syringes. He advised he did not and provided verbal consent to a search of his bag and person. I again asked him if he had any “rigs” (syringes) and he stated he did not.
As I was conducting a search of Michael’s back pack I located a used syringe in the front pocket of his backpack. Michael informed Officer D. Peal (9003) he had a syringe in his pocket. A used Syringe was recovered from Michael's pants pocket; He was secured into handcuffs (double locked) and advised he was no longer free to leave.
Michael was read Miranda from an agency issued card and verbally acknowledged he understood his rights. He advised the syringes were for his personal use and were used to inject himself with heroin. Michael was secured into the back of my patrol vehicle and the syringes were field tested. The syringe from Michael’s pocket was tested without a positive result. The syringe from the backpack tested positive for heroin. The syringes were later placed into evidence at the PRPD.
