Some believe that getting drug tested is an infringement on their personal rights. There are many recreational drug users that may use drugs of some kind on their own time and are never under the influence of any drug at work and can be exceptional workers. The question becomes should they be penalized or denied a job because of their off work habits? This is a difficult question to answer, however the prevailing mood seems to be yes. The other concern in my mind is what if a drug test delivers a false positive because of legal drug interactions, a defective test or even medicinal purposes of an illegal drug like marijuana for instance. These potential pitfalls bring with them a host of dilemmas from both a legal and regulatory standpoint. Also, the issue of marijuana being legal in certain states in the United States could also present challenges to drug testing laws moving forward. Time will tell but certainly these issues will clearly continue to become hot buttons issues on both sides of the drug testing spectrum and issues moving
