physician and patient to be performed at an ASC. Plaintiff’s Motion, p. 17, 21-22 To get to this interpretation, Dr. Newman argues that the phrase “under applicable Medicare regulations” in the definition of “outpatient surgical procedures” somehow refers to the Medicare Claims Processing Manual (which is not even a Medicare “regulation”). Specifically, Dr. Newman cites to Section 20.1 of Chapter 14 of the Medicare Processing Manual, which provides: “The ASC list of covered procedures merely indicates procedures which are covered and paid for if performed in the ASC setting. It does not require the covered surgical procedures to be performed only in ASCs.…

In the case of the State of New York vs. Steve Harmon, the defendant is guilty, based on the evidence that he was involved in the murder of Alguinaldo Nesbitt. There is no doubt that Steve Harmon acted as a lookout for the robbery of the drugstore on 145th street in Harlem. The first reason leading to believe that Steve harmon is guilty of the involvement in the murder of Alguinaldo Nesbitt is that during his testimony he clearly stated that he was not in the drugstore at the time of the robbery, but on page 128 of his journal he wrote “I thought about writing about what happened in the drugstore, but i’d rather not have it in my mind. "(Myers…

According to Bachman & Schutt (2014): Research should expose participants to no more than minimal risk of personal harm, researchers should fully disclose the purposes of their research, participation in research should be voluntary, and therefore subjects must give their informed consent to participate in the research, and confidentiality must be maintained for individual research participants unless it is voluntarily and explicitly waived. (p. 60) Although Dr. Coswalt protects the research participants from no more than a minimal risk of personal harm, the research scenario still violates three of these principles. Dr. Coswalt has failed to fully disclose the purpose of her research to the participants and their guardians. Dr. Coswalt and the participating schools mistakenly believed that the students and guardians should not be informed of the study, so that students would not change their behavior, a term known as the “Hawthorne effect” (Bachman & Schutt, 2014, p. 192).…
