physician and patient to be performed at an ASC. Plaintiff’s Motion, p. 17, 21-22 To get to this interpretation, Dr. Newman argues that the phrase “under applicable Medicare regulations” in the definition of “outpatient surgical procedures” somehow refers to the Medicare Claims Processing Manual (which is not even a Medicare “regulation”). Specifically, Dr. Newman cites to Section 20.1 of Chapter 14 of the Medicare Processing Manual, which provides: “The ASC list of covered procedures merely indicates procedures which are covered and paid for if performed in the ASC setting. It does not require the covered surgical procedures to be performed only in ASCs.…

In April the patient set up a preoperative examination with Dr. Becton. She claims that there was a nurse in the room for the pat smear. The nurse and Dr. Becton left the room as the woman was getting undressed. Dr. Becton returned but without the nurse (which it isn't against the law to have a nurse in there but according to Linda Hutchison that pretty much every doctor had a nurse present during the exams.). Then he told her to lie down on the table.…
These Spartans of Spillane Middle School, however, wield their swords with alacrity and have dominated state tests and academic opportunities across the board. Spillane’s index was almost double at 95. In addition to that, the post secondary readiness of all students regardless of grade earned a score of nearly 70!…

Thankfully, Americans today are provided with countless resources specialized in treating this hard-to-overcome addiction. Through the services of doctors from all backgrounds, psychologists to psychiatrists, addicts across the nation are given a fighting chance at recovery. Nearly all of these programs choose to follow the same guidelines, which usually involve a form of medication-assisted treatment.…
According to Bachman & Schutt (2014): Research should expose participants to no more than minimal risk of personal harm, researchers should fully disclose the purposes of their research, participation in research should be voluntary, and therefore subjects must give their informed consent to participate in the research, and confidentiality must be maintained for individual research participants unless it is voluntarily and explicitly waived. (p. 60) Although Dr. Coswalt protects the research participants from no more than a minimal risk of personal harm, the research scenario still violates three of these principles. Dr. Coswalt has failed to fully disclose the purpose of her research to the participants and their guardians. Dr. Coswalt and the participating schools mistakenly believed that the students and guardians should not be informed of the study, so that students would not change their behavior, a term known as the “Hawthorne effect” (Bachman & Schutt, 2014, p. 192).…
9. Dr. Rodricks claims that NCR knew or should have known that PCBs would be present in recycled paper made from NCR broke and used for food packaging, and NCR could have taken measures that would “prevent PCB contamination of food and food packaging, actions that would again have reduced or eliminated PCB contamination of the Kalamazoo.” Dr. Rodricks provides no evidence that recycling facilities on the [Fox]Kalamazoo River used any NCR broke in the manufacture of food packaging. FDA began surveillance of foods and food products in 1969 in response to concerns about PCBs; although the analytical technology to detect PCBs and differentiate them from DDT and other chlorinated pesticides was not refined until 1970.…

My last and final question to Dr. Wydra consisted of wanting to know if she could tell her past self anything while going through school what would it be? Her response was, that B’s get Ph. Ds. and that she wishes she had given herself a little slack while completing her degree requirements while better enjoying her life. This question also really hit home for me because I tend to neglect my social life while in college because I stress highly over getting into graduate school.…
Children fall into the category of individuals of vulnerable populations. Not only they are unable to make a voluntary decision regarding their treatment, or give an informed consent to treatment, but also their lives are valued less than of a mentally and consciously formed adult. Our hospital was faced with a case of baby named Barbie who suffers from an inherited condition that had taken away both of her siblings who were patients in our hospital as well. Already showing indications of liver failure, the baby will not survive more than a year without a suitable donor organ. The baby’s parents are unable to help her with a transplant because both of them have milder versions of the condition.…
