In 2011-2012, Florida was the state that had the most suspensions throughout the whole United States. Florida had 19% of their students being suspended. This relates to Domanik due to the fact that instead of being arrested for a minor crime, he could have been easily suspended like the rest of the 19% of Florida’s middle school students. It is important for the middle school to take into consideration how much arresting Domanik will affect him. Now, an ethical appeal would be having experts agree on how arresting Domanik was too much for the prank he committed. For example in Washington, a student wanted to be charged for causing a scuffle in the bus. This created much tension due to the fact that the reason for wanting to be charged was immature. Police experts clarified that no kid under the age of 17 should be arrested for a minor incident. Now, this proves that Domanik’s consequence was unreasonable and harsh. If policemen in Washington agree with not arresting a kid until the age of 17, policemen in all states should also. Lastly, an emotional appeal would be Domanik’s middle school administration realizing that a mistake was made and having emotion towards Domanik’s arrest. Domanik had a past of misbehaving and of getting suspended, which takes a big part of this situation. Domanik had been suspended before for a reason similar to the prank he committed regarding the teacher’s desktop wallpaper. Much people might claim how if someone does something they are not supposed to, the chances of the person doing it again are high. In Domanik’s situation that was the case; therefore, it is of much reason that the administration wanted to teach him a lesson once and for all since he still had not learned from his mistake the past time. Also, changing a teacher’s desktop wallpaper should not seem much of a big deal, but the fact that Domanik changed it to the picture that he did and how he had all access to the grade book, indicates the severity of the “prank.” As mentioned before, Domanik changed the wallpaper to a picture of two men kissing, which he could have placed there to make fun of his teacher or just simply take it all as a joke. Nonetheless, whatever the reason was for placing a disturbing image on the teacher’s wallpaper was, it could have been avoided. The fact that Domanik has a history of misbehaving gives some feedback on having him arrested.
