Law Protection Paper There are several amendments in the Criminal Justice System. I will be talking about the fourth, fifth and sixth amendment. I will explain what the amendment means, how they affect the Criminal Justice System, and how each of them protects the defendants’ rights. Fourth amendment protects people form unreasonable searches and seizures by the government. The fourth amendment is not a guarantee against all searches and seizures, but only those that are deemed unreasonable under law (uscourts.gov). The fourth amendment only protects against searches and seizures conducted by the government (criminal.findlaw.com). It should not be violated and no warrants should be issued under this amendment, but upon probable cause and supported oath the place can be searched and the person or things can be seized (USHistory.org). The fourth amendment is important to our Justice system because the police don’t have a right to do anything to your personal belongings without a search warrant or trial. The Fifth Amendment states that no person shall be compelled in any criminal case to be a witness against themselves. The Fifth Amendment gives criminal defendants the right to refuse to testify to the fifth. (Realties and Challenges PG 213).
