The distinction between general intent crimes and specific intent crimes can sometimes be hard to distinguish between. To help distinguish between the two, one should ask, first, what the intent (or knowledge) if any does the crime require; and then, if the crime requires some intent (knowledge), did the defendant in fact ascertain such an intent (Brody and Acker, 2010).

First, in a crime of attempt there are two major factors that must be present: criminal intent, and a criminal act. The intent must be done purposefully. Meaning that if a man died because his brother shot him, the brother would have had to purposefully pick up the gun and had the intent to shoot him. For a criminal act to occur, the defendant must have gone beyond preparation and moved toward the perpetration of the crime. It is important to remember that If perpetration has not occurred there is no criminal act.…

Rape shield laws limit the use of evidence of a victim’s past sexual history that might undermine the victim’s credibility. The purpose of rape shield laws is to protect victims from emotional distress when cross-examined about their sexual history (Brody & Acker, 2010). Courts feel the victim’s sexual history has little relevance and the humiliation and fear of being questioned about their past sexual conduct might prevent some victims to come forward (Brody & Acker, 2010).. In Tennessee, Rape shield laws were adapted in response to a sexist view that a woman who had sexual relations in the past was more likely to have consensual sex with a specific criminal defendant (Brody & Acker, 2010).…

Felonies and misdemeanors are two classifications of crimes used in most states, with petty offenses (infractions) being the third. Infractions are the least serious type of crime. However, if infractions remain unaddressed or unpaid, the law typically provides for an increasing range of fines and potential penalties. For example, littering would be a minor infraction.…
