Detrimental Reliance Case Study

Decent Essays
I think Rita would win against her uncle. Detrimental reliance means “did someone say or do something that would lead a reasonable person to believe there is a deal? In this case Rita’s uncle implied that if any of the nieces or nephews traveled through Europe he would give them the money back for the trip. She could prove promissory estoppel against her uncle, which means a promise was made, the promise was reasonable, the reliance was detrimental and the injustice can be prevented by enforcing the promise.

Even assuming Dr. Stout’s allegations are true, his claim of fraud in the inducement fails because Dr. Stout’s reliance on any purported misrepresentations was neither justified nor reasonable in the face of open and clear contractual language to the contrary. Accordingly, Dr. Stout’s claim of fraud in the inducement cannot be supported. Regarding the requirement of “justifiable reliance,” the Court has held that “justifiable reliance is an essential element of both fraud and negligent misrepresentation.” Helms v. Holland, 124 N.C.App.…

Vineet Nayar extensively followed the change models proposed by Lewin and Kotter. Kurt Lewin developed a three stage model of planned change that discusses how to initiate, manage, and stabilize the change process. The three relevant stages are known as unfreezing in which you create a motivation to change, changing, by implementing your new strategies and structure in place, and refreezing in which you support and maintain your change (Kreitner & Kinicki, 2013). For example in the case study, Vineet implemented the 3 stages of Lewin change model in how he wanted to see change take place and he exhausted several avenues to come up with new innovative ways to be productive and competitive, allow his employees to add more value,…

    Promissory Estoppel Essay

    • 707 Words
    • 3 Pages

This essay seeks to discuss the Doctrine of Promissory Estoppel and the Doctrine of Consideration, as well as a clear analysis, with the use of case law, how Promissory Estoppel has become an exception to the general principle that a promise may only be enforced if it is supported by good consideration; it will ultimately conclude whether or not a promise to accept a smaller sum in discharge of a larger sum, if acted upon, is binding notwithstanding the absence of consideration. A contract is a legally binding agreement in law between two or more parties, which is enforced by law or by binding arbitration if it covers the elements of a valid legal agreement. For there to be a valid contract, three elements must be present, offer, acceptance, and consideration. If there is no consideration, there is no contract; however, with promissory estoppel instead of consideration, if there is a promise which induces reliance, the court would find some sort of liability for the promise.…

It’s like making up excuses to prove to yourself, that you are right. Taking yourself out of the equation and putting yourself in someone else’s shoes, so you can see an issue from someone else’s point of view is helpful to me. Repression is another ego defense that I have to keep in check.…

The snake represents her mother in some way, so when faced with one she feels fear, but as these feelings are in the unconscious mind, she cannot express the reasons why. These memories are personal to Anna so Bjorn does not express the same fear. However, this study lacks temporal validity because it was conducted over a hundred years ago, and since then psychologists have developed opposing theories with higher levels of accuracy. Also, the study raises the issue of treatment fallacy as although the psychoanalytic therapy worked for Hans, this does not mean that the main cause was dealt with, meaning an alternative cause was more likely the reason behind the phobia. The study of Little Hans cannot be generalised to the whole population as…
