This can prove to be tricky if the person doesn’t give a reason upon arrest. The example they use in our book of Erika Mendez, who killed Sunando Sen by pushing him onto “tracks of an elevated subway station in Queens”. Upon her arrest she said, “because I hate Hindus and Muslims ever since 2001 when they put down the twin towers I’ve been beating them up {sic}”. She thought that Sen, who was born in India, was a Muslim (Gaines 126 ). In that instant the defendant gave you her motive, but other times it’s not so easy. A hate crime can have multiple motives. For example let’s say an observing male autistic Muslim from the middle east is attacked and beaten to death outside a mosque (“Islam”). Now the police need to figure out if he was attacked because he was a Muslim, or because he acted strangely or because he’s not an American. Another example is an Orthodox Jewish man is attacked and severely injured. During the investigation, it is found out that he’s also gay. Did his attackers know this and attack him for that reason or was it because they’re against Orthodox jews? Again there can be more than one motive for a hate crime and it’s the job of the criminal justice system to figure it out. These are just a few examples of why doing that might be
