Kristen’s mother brought action on behalf of her daughter by filing a case against Rose, Principal Cohen, and Fairfax County School Board under Title II of the Americans with Disabilities Act and intentional infliction of emotional distress under Virginia law.
As I summarized the background of this case, we should know that depression is one of the most common yet under-identified mental health problems of childhood and adolescence. One may ask, what is Depression? Depression is a mental illness in which a person has feelings of sadness, instability, loneliness, hopelessness, worthlessness, and guilt. Depression is a common mental disorder and can be successfully treated.
Furthermore, depression has an effect on academic and social performance among many other things. Children and adolescents who are depressed generally want to be successful academically and socially, but lack the ability and motivation; they are not choosing these behaviors. A small proportion of depressed students show serious thoughts of planning or attempting suicide. Students with depression needs to receive extra support and caring as well, not criticism, punishment, or indifference. The teacher and principal should have learned more about depression and strived to help Kristen overcome this obstacle. Educator are not just teachers but advocators for their students to fight for what is best in that student’s life. We need to strive to learn our students, praise and motivate them and guide them to accomplish their dreams.
