Their logic was rooted in the fact that the members of the fraternity party had ample time and opportunity to remove themselves from a situation any reasonable person could see was about to get bad. The justices reasoned the owner of the establishment should not be held responsible for the injuries that occurred to the defendant, as there was no specific warning word they could have used to get everyone to leave the premises in order to avoid any of the injuries from happening. Moreover, since the courts have yet to establish a word that establishment owners can use when dangerous situations occur within their businesses that can lead to patron being injured or worse. Noteworthy, the dissenting judges are Justices Hecht, Wainwright, and Johnson. Interestingly, the research reveals that the dissenting opinion of Justice Hecht was later joined by Justice Johnson.
