By almost any measure, the federal prosecutor's wielded too much power. Many federal laws govern similar behavior and are written broadly, prosecutor's commonly have multiple charges from which to chose. This means they typically have many sentencing ranges to chose from as well. Thus, they can--and do--threaten defendants who want to exercise their trial rights with charges that will carry longer sentences than the charges will file if defendants who refuse to waive their rights to a jury trial receive a sentence three times longer than who pled. And with the prevalence of mandatory minimum laws, a prosecutor's charging decisions often dictate a sentence that a judge is powerless to avoid.…

Therefore, the pressure of facing a costly trial leaves those innocent or partially innocent vulnerable and willing to accept the terms of a Plea bargain. The likelihood for a young adult to use the court system to there advantage is less likely then the crime happening in the first place (FBI, 2013).…

The United States NY Federal drug sentencing guidelines compel disproportionately harsh sentences with a primary focus on racial disparity among poor communities. Drug crimes account for 51% of the offenses in federal prison and of the 195,933 federal inmates 69.7% of those individuals are African Americans and Hispanics. That is nearly three quarters of the total prison population. This exhibits the racial disparity within the prison system. Studies from Rehavi of the University of British Columbia and professor at The University of Michigan explains that the racial gap and discrimination of African Americans to White Americans are due to mandatory minimum filings by the prosecutor; black males are twice as likely to be affected by these…

As a defense attorney, it is my responsibility to properly defend my client, regardless of a coerced confession of a crime. A defense attorney is an advocate for their client, and always works within their abilities to make sure that their client has a fair trial and is protected from any injustices that they may be presented with, even if they know that the client is not innocent. This is part of the role of devotion and integrity that a defense attorney portrays to support their client. If my client had been coerced into a confession, and without hearing their miranda warning, it would be my duty to expose those injustices and use them as leverage in my case. In our book, it says that "the fight for justice and equality for everyone, regardless…
