Sentenced to death. Many criminals in our country receive the controversial sentencing of the capital punishment. While the argument can go both directions, In the United states the death penalty should be abolished because it is a violation of the constitution, is a waste of time and lacks deterrence. The death penalty is in many opinions a violation of the constitution. According to recent studies by Justice Breyer, “The death penalty involves 3 fundamental defects. 1. Serious unreliability 2. Arbitrariness in application and, 3. Unconscionably long delays.” (Breyer). This proves that the death penalty provides no relationship to the constitution. In quotation of Heyns and Mendez, “Studies found no empirical support for the argument that the existence or application of the death penalty deters prospective offenders from committing homicide.” (Heyns). On the other side of this argument, and with reference to the article written by Jacoby, Jeff. “When a murder is punished with nothing worse than prison more criminals will be emboldened to kill.” Well, Mr. Jacoby is incorrect in his statement and here is why. Many criminals on death row are glad they are on death row due to the reasoning with which they are able to receive freedom through death. Wouldn’t anyone who would otherwise spend their entire life in prison, want the freedom of leaving this world? Because they are, in fact, free from prison when they pass away. So, avoiding this situation completely; if a criminal is punished for a crime they committed, they should spend the rest of their natural lives wasting away in prison. Also proving Mr. Jacoby incorrect, is his own words, “The death penalty does not make our communities any safer and is not a deterrent to crime.” (Jacoby). The death penalty is not a deterrent to crime, and it never will be, “…criminality is not a synonym for stupidity” (Jacoby.) and any criminals know when they commit crimes that if they get caught they will be punished.
