The primary role of the State District Court is broader in that they hear many more types of cases. They also hear cases that are criminal and civil in nature. However, they also hear cases for private …show more content…
District Court would be better suited to hear the case. The Federal Court has hierarchy over the State Court and robbing a bank is a federal crime. Hierarchy is important as it ensures the judge is more experienced to handle complex cases, such as this one. Federal Courts hear fewer cases than the State Courts so they are not as over worked and will have more time to prosecute the case. This will also prevent the case from suffering major delays denying due process and overwhelming the already overworked State …show more content…

The process will generate a more efficient process for the Court Clerk to watch timelines and ensure cases are scheduled appropriately. The CM/ECF should allow more time for the clerk to spend on the docket (U.S. Courts, 2015). The use of CM/ECF will help the process of calendaring and maintaining the docket more efficiently. This will allow the clerk to check the dates of filing and check how the cases are processing through the system and if a case needs any additional attention. They can also use the system to show if they are on time with scheduling or if something needs to be improved at a

From 1801 to 1835, the Marshall Court consisted of six to seven Associate Supreme Court Justices and Chief Justice John Marshall. He was part of the “Midnight Judges” appointed by John Adams on the last day of his presidency, in an attempt for the Federalists to dominate the judicial branch. Marshall was one of the last remaining Federalists involved with the government and his influence on certain cases lasted much longer than the Federalist Party itself. The Marshall Court increased the power of the federal government in terms of the meaning of a contract, the power of the federal government versus the power of the state government, and the regulation of interstate commerce. This became apparent in the Supreme Court’s rulings on Dartmouth…

Selalla (2008), involves Kevin Ballesillo Selalla (Selalla) who was charged in South Dakota on 27 July 2005 for drug possession, drug dealing intent and assuming fake identities intended to mislead law enforcement. Prior to the trial, Selalla claimed having limited knowledge of English and in response, the trial court hired a Spanish/English interpreter to assist Selalla. However, the Public Defender’s office took liberty in hiring another interpreter to facilitate communication between the defense counsel and Selalla. The trial court then dismissed the interpreter it had hired citing that retaining more than one publicly-funded interpreter is unwarranted. This analysis seeks to examine the role and administration of courtroom interpreters.…

As we have seen from Part I of this note, Supreme Court jurisprudence is extraordinarily deferential to police officers’ actions and decisions, reflecting an often expressed idea that police officers are simply doing the best that they can in a difficult job. Our deep-rooted system of deference makes it far too difficult to hold police officers and departments accountable for any misconduct. Section 1983 litigation does nothing to help control or regulate police use of force because (1) only a small fraction of section 1983 litigation is successful and (2) even if the plaintiff prevails, the multi-million dollar payouts and settlements only punish the city’s taxpayers and does nothing to incentivize departments to control or regulate police…
