Corey Kessler Case

My case was over Corey Kessler. He was 15 and charge in a adult court with first-degree International homicide. 10 months later Criminal Court jurisdiction transferred Kessler`s case to juvenile court. Then the court appeals reversed. Kessler had the right to "reverse waiver". He has to show preponderance of the evidence if he can not show proof then he will be retained for prosecution in Criminal Court.

His next hearing was on November 29th Kessler submitted a criminal a rehearing questionnaire and waiver form that was signed by him and his attorney Ashley stated that he knew the state can establish probable cause and that he would be ordered to stand trial. He was now 16 and going to see dr. Bryer. Dr. Breyer stated " scatter describe it was that it was a rage reaction when he was very fearful." Corey said that he had drank alcohol before going to the victim's house he just wanted to pose for him and leave and that he was surprised when Adams wanted to have sex with him. He said that he tried to rape him and the items was choking him and pulling his pants down to his ankle so he grabbed the hammer and hit the victim. He said when he showed up that posing nude for the victim started out in the same routine as it had previously. He said he did this because he was broke at the time and needed money. And his last court case they stated " I conclude that the circuit Court did not erroneously exercise its directions I would affirm its revised waiver determination." However given the passage of time in the current age of the juvenile I recognize that reverse waiver May no longer be approved yet or even visible. I would instruct the court to determine if revised waiver is still appropriate …show more content…
Although on this one I don't really know what to think I understand that he was in fear but a 15 year old should know when to stop beating somebody. And on top of that he knowingly stabbed him after he knew he was already hurt. What also was really sad to me is that his dad knew for 3 days that he had killed somebody and nothing was said about it. I don't know how any father could hide that. Wouldn't you think that he would want to get his son help? Overall I think my opinion is yes that he should have been tried as an adult. I know kids are kids and they have time to learn but in cases of kids killing people I think it's a different story. I would be more understanding about the situation if he had maybe stop beating the victim after he was already down and hurt but he continued to grab other items to kill the victim. If any child feels in danger and feels the need to fight back yes I think they should but not intentionally to kill them just enough to get away and ask for

The victim was only 25 years old, cause of death was due to an acute poison in the victim’s drink. We had to prove the defendant committed the heinous act, and I was feeling pretty confident as I walked into the room and stood in front of the pleasant mahogany desks. The defendant did do it, all the evidence pointed to it. Pretty straightforward, or so it would seem from an outsider’s point of view. But I knew better, Sharpe knew better, Finch knew better.…

While the “criminal is a child” approach to the juvenile justice system is appealing due to its forgiving nature and emphasis on rehabilitation rather than punishment, there are some cases in which this decision is not so cut-and-dry. One of these instances of a legal “gray area” is the case of Marin Sinzer, who was charged for the murder of Tammy Shevin, 25 years after the crime was committed. The now 38 year old is petitioning to be tried as a juvenile, since he was only 13 at the time of the crime, a year younger than the waiver age at the time. While many proponents of the “criminal is a child” approach take that stance because of the physical and psychological dangers posed to juveniles who are placed in adult prisons, in this unique…

There have been many opinions on juveniles being convicted as adults on the crimes they have committed. When it comes to some of these harsh crimes, who could not punish the individual to the fullest? It does not matter how old a person is because everyone knows the difference between right and wrong. If someone is raised differently and believes it is okay to murder another human, than they cannot just change their mindset. An individual that makes and adult decision should have the same consequences.…
