It all started in January 2013, when Matt Corby a teenage boy from Australia posted a Facebook post showing his Subway foot long sandwich measured up to less then a footlong. Within days his post received over 100,00 likes, several hounded comments, and dozens of copycat pics. Though it didn't receive any attention from Subway whom is among one of the biggest fast food chains in the world. It did receive global attention and within days had made its way here to the United States. Either by coincidence or chance within days of this posting lawsuits were filed both in the state of Illinois and New Jersyey. Mr. Nguyen Burens and his attorney claim that this is a pattern of fraudulent, deceptive, and otherwise improper advertising, his attorney also added to there complaint by say in comparison that his sandwich not adding up in length is comparable to if a consumer had purchased a dozen eggs, but only received 11 in return. Elsewhere in the state of new jersey other consumers had also filled complaints 2 men named John Farley and Noah Pendrack, were both looking to claim 5 million dollars, for the same issue. The suit was filed under the new jersey consumer fraud act, The complaint claims that it is a deceptive practice for subway to advertise its large sandwich as a foot long when it is not. Stephen DeNittis, the lawyer for the plaintiffs in New Jersey stated that his clients purchased subs from 17 different subway shops, measured these subs and none of them were a full foot long. The lawsuit claims it is a deceptive practice for subway to claim there sandwich is a foot long, when it just doesn't measure up, and that this Case was about holding companies to deliver what they've …show more content…
Like the example used above we would never by eleven eggs with satisfaction, when the carton says a dozen. Let's say a subway restaurants sells 500 sandwiches a day, and one inch is missing from each sandwich they sell, at the end of the day that's 500 inches of missing sandwich. All those missing inches equal about 40 sandwiches a day that subway is keeping the profit from without selling. Most customers would agree that half an inch to an inch of missing sandwich is not a huge deal but, when you break it down and look at the big picture it's thousands of dollars a year that subway is profiting from, while there customers are losing out.

In the end it's hard to believe that this all started with a simple face book post calling out one of the biggest restaurant chains in the world. One picture that went viral caused a chain reaction leading to others in other countries to file suit, and fight for there missing inches. Still to this day subway is using there marketing promotion and offering $5 foot longs. The slogan has been trade marketed by Subway restaraunts , and the claim still exists that a slogan is exactly what it is, a slogan, and the term foot long has never been meant to be used as a measurement of
