After the revolutionary war, America was struggling with finding an effective Government that does not include a tyrant for a leader. For the first few year of freedom, America followed the Articles of Confederation. In 1787, when the Constitution was created, it was agreed that the Constitution should be able to make an efficient government free of tyranny.…

The original 10th amendment from the bill of right stated that “the powers not delegated to the United States by the constitution, nor prohibited by it to the states respectively or to the people.” (cooper class notes). This amendment is now as the “States Rights”, these rights were meant to have a separation between state government and federal government, just like the separation of state and church, there needed to be a balance between level of governments. As Boyd (2015) explains, constitutional law is special in that it cannot be subjected to alteration through “the mere passage of new law through the House of Commons and the Senate” (p. 98). On the surface, this fact appears to guarantee respect for the authority of the rights laid out in the Constitution. This is significant because constitutional law supposedly, in the words of Cheffins and Tucker (as cited in Boyd, 2015), is a “mirror reflecting the national soul” (p. 98). However, many reject the claim that the Canadian Charter of Rights and Freedoms [hereinafter, Charter] has brought about greater respect for fundamental rights and freedoms.…
