Four days after arriving in Richmond Burr was taken to a room in his hotel for examination by Chief Justice, John Marshall. Starting the examination was District Attorney George Hay. He supported the charges of treason, and said that Burr was gonna acquire New Orleans by force. Edmund Randolph Burrs Defense Attorney says that he did not overt any act of treason. Burr then addressed the court and argued his interpretation of his actions, and also brought up his acquittal by the grand jury in Mississippi Territory. Marshall found that the prosecution did not have enough evidence of treason. Burr was then set for a trail on a high misdemeanor charge. This action made President Jefferson very mad. He began to think that Marshall’s favor was in Burr. Jefferson now is on a mission to make sure Burr is convicted. The trial now started in Richmond, Burr had his team of defense lawyers; Edmund Randolph, John Wickham, Benjamin Botts, Charles Lee, and Luther Martin. On the prosecution was George Hay, Caesar Rodney, William Wirt, and Alexander McCrae. The prosecution moved to charge Burr on treason once again. The defense then argued that two witnesses must testify to establish an act of treason. The first witness was General William Eaton, he admitted to a meeting in Washington with Burr in the winter. Several other people were brought in to talk about the events that happened at Blennerhassett's Island. This is the only thing the prosecution has as evidence of treason against Burr. William Love was questioned by District Attorney George Hay about the events that he observed on Blennerhassett's Island. Marshall found that Burr couldn’t be found of treason based on events at Blennerhassett's Island. The final decision was made that Burr could not be found guilty of treason based on the evidence
