They could look at how they purposely avoided the roadblock after police tried to intercept Ryan and the rest of the men. This shows that they didn 't want to come into contact with the police at all, which resulted in a blown tire. The Crown could argue how Moore refused the commands from the officers to get out of the truck, which resulted in the use of Baron the police dog. The intent to wound from Ryan using the firearm would also be taken into account as an aggravated circumstance. The Crown also contend how Ryan has gang ties and if he really wanted to avoid criminal activity he would have already eliminated all associations with gang ties and other people with severe criminal records.
