All this happened after the mother of the siblings left them in the house to go clubbing with no adult or babysitter to supervise the house full of children under eight years old. The young boy was charged with murder while the mother accused of manslaughter. The controversial issue of the story CNN and Fox news presented focuses on how prosecutors are going to prosecute an eight-year-old for murder and whether is it ethical for the mother of the eight-year-old to be part and be charged for the death of the one-year-old. Emory Anthony, Lewis' attorney, voiced CNN associate that “manslaughter is appropriate when someone acts recklessly or irresponsibly, not when they allow someone else to act in a dangerous manner” (Anthony, 2015). Fox News pointed out that the mother should have known the danger she put on the children when she stepped her foot out clubbing; therefore it is justified for her to charge with manslaughter. The credibility of the story was acceptable because this is an unexpected and controversial story that will have some impact on the boy’s family, the justice system and to everyone that is listening to this story. There is no doubt that the two separate cases of Roper v. Simmons and Thompson v. Oklahoma the act of murder was committed by minors who were tried, convicted, and deserving of a fitting punishment. However, in this analogy between the primary and secondary analogue, the argument of Roper v. Simmons is if a minor under the age of 18 should be sentenced to Capital Punishment, and if doing so is a direct violation of the Eighth Amendment citing cruel and unusual punishment (Roper v. Simmons, 2005). The Supreme Court ruled in the case of Thompson v. Oklahoma, “that executing persons for crimes committed at age 15 or younger constitutes cruel and unusual punishment in violation of the Eighth Amendment” (Roper v. Simmons, 2005). In part, because Oklahoma’s death penalty statute set no minimum age limit in which he or she would be sentenced to death (Flaherty, 2002).…
