The collective bargaining agreement effectively covers all employees within the business, but is being a supervisor considered equivalent to an employee under the CBA? The supervisor does have the right to act independently and autonomously (without asking upper management); specifically, to ensure that those under his watchful eye act to complete or improve business. Ultimately all employees answer to the management; however, when Vern Tucker is on shift, he is considered to be the immediate supervisor of the employees, ultimately responsible for the productivity during his hours. Essentially, he has a more sophisticated role than your basic employee, which bears the question, does Mr. Tucker fall within the same scope as a basic employee? The recognition clause in the collective bargaining agreement does include all those who are deemed “employee to an employer”, typically excluding those who perform managerial functions. Even though he only has responsibility during the shift, and does not carry extensive disciplinary responsibilities, he does have a supervision responsibility described …show more content…
With this rule in place discipline would be found with just cause under article 2 Management's rights of the CBA. This makes all actions of discipline within management right to do so and does not breach any section of the collective bargaining agreement. Nowhere within this rule does management restrict the right of the employee to pursue romantic relationships with fellow employees. However management does request that all PDA’s be limited to outside the workplace. Management is only requesting that employees act in a professional manner when representing the company during their work hours. Employees are considered an extension of the company and it is in the best interest of all parties to refrain from conduct that could detrimentally harm business
