There is right, there is wrong.
In an ordered society you must have rules and regulations, because your view of what is right might, in my view, be wrong.
Every law, every rule, every regulation has to be able to be broken down to simple yes/no answers.

In both scenarios, by the letter of the rule, Code 412 could be applied.
I, or Lawyers, can argue that section (i) of TCA 49-6-3401 should be applied, and Joseph not face any consequences.
I, or Lawyers, can bring up all the due process concerns, citing I's not dotted, and T's not crossed, and Amendment this or Amendment that violated.
And all the while Joseph is not learning.
Joseph is a Good kid. He wants to learn, he wants to go to school. He has made mistakes, paid the price for these mistakes, learned from these mistakes, and Changed himself for the better from these experiences. I am Proud of him. His whole life is in front of him and he sees it, is begining to understand it, and wants to have a good life.
