On 7/27/2016, at approximately 1734hrs, I responded to the 100blk of N Penn Ave. in reference to an intoxicated male trespassing on railroad property. I made contact with Daniel Clapp DOB 02/21/1982, on the trail tracks near the railroad crossing walking westbound. Clapp was carrying a bottle of Congress Vodka and appeared to be intoxicated. I told Clapp he was under arrest for trespassing and placed Clapp under arrest. While speaking with Clapp I could smell a strong odor of intoxication coming from his breath and person. While searching Clapp I located a cigarette pack inside Clapp’s pants pocket. The cigarette contained two cellophanes. The two cellophanes contained pills.
While placing the wrist restraints on Clapp he became outraged because he was being arrested. Maj. Hughes arrived on scene and Clapp became more outraged and started to yell out Maj. Hughes. While transporting Clapp to my patrol vehicle, Clapp continued to cuss at Maj. Hughes. Clapp then pulled away from me and started yelling at Major Hughes. While Clapp turned towards Maj. Hughes I turned around and seen Maj. Hughes almost get head butted by Clapp. Maj. Hughes dodged Clapp’s head and pinned Clapp against my patrol vehicle by grabbing underneath Clapp’s jaw and pushing him back. Daniel started to get so mad

Hughes two times while I opened my patrol. Major Hughes had to force Clapp into my patrol vehicle. Clapp resisted Major Hughes and continued to be out raged, cussing and kicking his feet. Maj. Hughes got Clapp in the patrol vehicle with the seat belt fastened.
I transported Clapp to the Brookfield Police Department and placed him in a holding cell.
I identified the pills by using Drug.com. Clapp’s cigarette pack contained 17 pills in one of the cellophanes and 4 pills in the other cellophane. The pills identified as Diazepam 2mg. Diazepam is classified as a Schedule 4 controlled substance under the Controlled Substance Act (CSA).
