According to the above petition filed on February 21, 2017, by Portsmouth Police Officer M. Moore, the following incident occurred at Churchland Middle School, located at 4051 River Shore Road, in the city of Portsmouth: “On February 16, 2017, at approximately 1400hrs, the victim had called the offender to her office to speak to him about a situation that occurred in a teacher’s room. After the offender wrote his statement about that incident, he was given his discipline of 10 days suspension. He then got very upset which prompted the victim to call Officer M. Moore back to her office. The offender had a hold of the desk as though he was going to flip it but then took off his backpack and threw it on the floor, stood up quickly and headed out of the office pushing the victim hard. Officer M. Moore followed behind placing the offender in handcuffs then having him sit down in a chair outside of the office trying to calm him down at which time he told Officer Moore to get out of his face. He was escorted out of school in handcuffs and placed in the patrol car. Prior to Officer Moore

He also stated, “I should have taken the 10 days suspension”. He further reported if he had accepted the consequences for his actions (making sexual suggested noises during class), which led to his suspension, he would not have incurred the offense which is before the court. He also stated he is not that type of student and he did not manage his behavior appropriately in the classroom which led to him being discipline by the victim.
