The police officers had to pursue defendant’s vehicle for five to six blocks until he finally pulled over the car. Id. Officer Kailer and sergeant Siani approached to the defendant’s side of the vehicle and officer Loud to the passenger lateral (A78).
Sergeant Siani and officer Loud testified that defendant Hardee was “wide-eyed”, appeared to be very nervous, moved around a lot and looked at Simmons and the backseat two or four times (A79, A81, A139, A142). Officer Kailer told defendant Hardee a couple of times to stop moving around and concentrate on the officers (A79, A81, A85). When Hardee continued to move and look around, officer Kailer asked him to step out of his car (A81). Defendant Hardee refused to immediately get out of the car by shaking his head. Nevertheless, defendant Hardee kept looking around, inside the car and “down the side street, … like that was going to be path he was going to run at.” (A84). Officer Kailer told defendant Hardee to stop looking back and warned him that he would be handcuffed if he did not comply (A85). Defendant Hardee immediately looked back into the car. Id. Officer Siani then attempted to handcuff defendant Hardee (A86). After officer Siani placed one of the handcuffs on Hardee’s wrist, defendant Hardee started to resist.
