Question 1 The Title VII of the Civil Rights Act (1964) has declared that all employers with a population of at least 15 employees and whose “business conduct” affects commerce, must maintain a workplace that is free from discrimination. The act outlaws all forms of discrimination which includes discrimination based on sex, race, color, religion or country of origin. In response, organizations have strived to reduce racial discrimination, of which age discrimination is a subtype (Hirsh & Kornrich, 2008). Employment discrimination litigation is expensive and costly for employers. The process can take years to conclude and often the employers fail to win the case, making it important for employers to observe the Title VII and ADEA provisions. Plump n’ Stuffy is a company with 202 employees and whose business is considered to affect commerce within the meaning of Age Discrimination in Employment Act (ADEA). According to (Hirsh, 2008, p. 250) employers can demonstrate compliance with Title VII through an attention to workplace procedures and structures that are consistent with fair employment practices. However, the majority of the employees (74%) who work in the company are between the ages of 21 and 30. The demographics in Jackson City show that the majority of people in the city are of African-American origin. Moreover, majority of the people are aged over 21 years and possess high school or higher education. In addition, the company has all of its cleaning employees being Caucasians. In order to comply with Title VII of the Civil Rights Act (1964) that prohibits discrimination based on age, gender, race and country of origin, the company must change its policy to ensure that its recruitment and employment practices.
