Green Rope Incorporated, my new employer, faces lawsuits due to some failures of the wire rope which caused a number of casualties in various construction sites as a result of poor quality wire product. Because of this, GRI is at a brink of closure.
Meanwhile, as a former financial analyst of Red Wire Corporation, I had a chance to join a stock-taking team and walked through the plant, and saw the critical process and specially designed machine that was internally developed. 3. If the RWC patented their machine and process, then the GRI may face lawsuits for patent infringement if they copy RWC’s machine and process.
“Where the subject matter of a patent is a process, to restrain, prevent or prohibit any unauthorized person or entity from using the process, and from manufacturing, dealing in, using, selling or offering for sale, or importing any product obtained directly or indirectly from such process”, (Sec.71.1 (b), R.A. No. 8293).
In relation to this the law also states that, “the making, using, offering for sale, selling, or importing a patented product or a product obtained directly or indirectly from a patent6ed process, or the use of a patented process without the authorization of the patentee constitutes patent infringement”, (Sec. 76.1, R.A. No. 8293).

They may also incorporate new ideas to innovate their product and process in general.
By doing so, they shall develop their own machinery and process without violating any patent. I, on the other hand, shall not besmirch my relationship with my former employer.
The only disadvantage of research and development is that it takes so much time and money to do. But the advantage that it offers is more valuable because it will not only make the business to survive but also to make the business more innovative.
F. Justification/Predicted Outcome/Recommendation
Taking into consideration all of the assumptions and analysis, I therefore recommend that it is best for Green Rope Incorporated to invest in research and development (R&D) to come up with a better production process and improved machineries.
