This MSI Sales Representative Compensation Agreement (“Agreement”) is entered into by and between ______________________, (“Employee”) and MITCHELL SECURITY INC. dba MSI, a California Corporation (“Employer”), and is dated, for reference purposes, as of the date the last signature is affixed hereto.
RECITALS
A. Employer desires to employ Employee as an MSI Sales Representative, and Employee desires to be so employed by Employer.
B. Exhibit “A” Sales Representative (SR) Duties, Exhibit “B” Commission Plan, Exhibit “C” Pricing of Solar Systems, and Exhibit “D” Non-Disclosure Agreement are hereby incorporated by reference into this Agreement.
AGREEMENT
1. Sales Representative (SR) Duties. Employee shall fulfill the duties of an MSI Sales Representative (SR) as set forth in the attached Exhibit “A”, and as further requested by MSI.
2. At-Will Employment. Employee’s employment shall be “at-will.” Under the “at-will” policy, neither Employee nor Employer is committed to continuing the employment relationship for any specific term. At Employer’s discretion, Employee may be paid an advance against future commissions based on an hourly wage for actual hours worked at the current legal minimum hourly wage up to eight hours per day or 40 hours per week. The hourly wage is an advance against commissions earned and governed by the Commission Plan attached as Exhibit “B”. Hourly wage advances are not guaranteed. Employee is compensated with commission in accordance with the Commission Plan.
