Jupiters Casino was rejected the application for a bargaining order against United Voice due to poor good faith bargaining. This is because there was limited participation in meetings and poor communication from both parties and no effective responses to proposals (Fair Work Act, 2009, NO.28). Flyers were posted in the bathrooms, corridors, and staff dining rooms, and on notice boards (Fair Work Commission, 2011, p. 5) by United Voice that provided misleading information about a wage increase to 1.5 percent. These flyers were posted after numerous bargaining committee meetings.
