Like the victim in Hinman, Joanie Blake will prove that Charles Harvey is liable for the damages sustained by Blake, based on the “direct and immediate” behavior of Harvey’s dogs (Lewellin 62). The said behavior led directly to Blake incurring significant injuries. The liability Harvey faces is reinforced by the Minnesota Statute that states, If a dog, without provocation, attacks or injures any person who is acting peaceably in any place where the person may lawfully be, the owner of the dog is liable in damages to the person so attacked or injured to the full amount of the injury sustained.…

In February 2009, Charla Nash was viciously attacked by her employer's chimpanzee while attempting to help get him back into the house, losing both of her hands and most of her face. She filed a strict liability claim against Sandra Herold, her employer and Travis' owner. For the first time in its history, the Superior Court of Connecticut ruled on the liability attaching to the owner of a wild animal that causes injury to another and subsequently allowed the personal injury claim to proceed. Survival in the wild is strenuous for all living beings, even for those adapted to nature. Wolves, even with their strong statures, their powerful senses of smell, and their sharp canines are no exception. Storms, fires, starvation, pollution, and other animals are just a few of the dangers of living in the densely packed forests that wolves tend to make their habitats. However, although humans have their own needs to take care of, kind and determined people can go the extra mile just to protect and nurture weaker animals, despite the difficulty of doing so. Some of these goodhearted people have invested in creating places of shelter for injured and sick wolves who are unable to return to the wilderness.…

It is not uncommon for the Pit-bull to serve as a “police, search, or therapy” dog. Unfortunately, the popularity of trained fighters has triggered the public to request bans against the loyal pets. Some stipulations for Pit-bull owners include cancellation of “homeowner’s policy”…

When applicable, agencies should not hesitate to prosecute owners for murder, manslaughter, or similar violations resulting from their animal’s actions, and their owner lack of responsibility. Laws should clearly define “dangerous” or “vicious”, and provide for established penalties. Penalties may include fines, imprisonment, and/or the relinquishing of total privileges to pet ownership. In modern societies, animals turned out to largely contribute to the development of both social and economic activities. In this sense, it is perspicaciously that a whole practical legislation has emerged to serve a beneficial purpose that is to maintain order within the community. Before considering what the Control of Dogs Act 1986 brought to the existing legislation related to dogs, it is of significance importance to clearly understand what the Act involves as well as to define what strict liability is in order to precisely assess the form of liability arising for the owner of a dog in case of a harmful conduct. Deprived of conscience, animals are capable of doing great mischief, this is why strict liability is applied in such cases:…
