Problem Statement:
The director of MegaBank, Judson Dillon, has to decide the future of Hydrofruit by finalizing an investment worth $65 million in the company. In considering the company, Hudson notices that the industry requires additional workforce so that they can be able to harvest the tomatoes. However, he notes that there is a risk of the company hiring illegal immigrants without documents which will be against the immigration reform and control act. Additionally, Hydrofruit can face legal action for discrimination by not utilizing individuals from a particular race if they diligently check the documents of the employees. Establishment of H-2A program in the company will make it possible for the company to hire enough workers from Mexico while observing the set federal regulations. The process of establishing the program requires Hydrofruit to provide evidence proving that there is lack of labor resources in the locality. The company will also have to apply for a temporary labor certification from the Labor Department in U.S. and then submit form I-129 to USCIS. The company can then set up an announcement about their need for workers which Mexican workers can access by applying for a visa. MegaBank will be able to gain up to 35 percent profit by following this recommendation. Consequently, the application process will eliminate smugglers and undocumented immigrants hence reducing the risk of the company facing legal action. Hydrofruit can upgrade its HR department by hiring experts and HR supervisors to check and validate the information and documents presented by potential employees. The HR department will be in charge of inspecting and ensuring that the employees being hired to have provided the company will truthful and relevant information which can be verified. Interviews can be conducted to validate the information provided and based on the outcome of the interviews, the HR department will decide which people to hire. The benefit of this recommendation is that it will ensure that all employees are in the country legally hence MegaBank will be able to gain profit. However, this suggestion exposes the company to possible legal action due to discrimination.
