If your blood alcohol content is 0.08 of above, you will be arrested for driving while intoxicated. I then asked what happens if your BAC is, say, 0.79? To which he told me that the person can still be arrested if they are involved in a moving violation, which is called DUI less safe. He gave me an example of a recent case, and showed me the report he filed on that case. He pulled over an older gentleman who had driven onto a curb late at night, the man seemed very confused, and Officer Onge had to repeat himself multiple times, each time the man not understanding his requests. The man did not perform the field sobriety tests correctly, and his speech was greatly impaired. So Officer Onge then had him breath into the breathalyzer and number came back 0.79. Even though he was under the limit, the man was still involved in a moving violation, this Officer Onge arrested him. I also asked about lesser cases, for example if someone BAC is 0.05 or less and involved in a moving violation. Officer Onge told me (and I remembered this from class) that police officers have complete discretion. He told me for him, if he believes a person is a danger to those around him, he will make an arrest. However, if their BAC is low and no one was harmed, he will tell them to get a cab home or have someone come pick them

According to the laws about comparative negligence, you are able to seek damages from the other party in a car accident. Even if you were partially at fault, you are entitled to recover the percent of the damages that was not your fault. If you were 40 percent at fault for a $100,000 accident, you would be able to recover 60 percent, or $60,000, of the total amount. The “No-Fault” Laws in Florida…

Tonight I rode with Officer Archibald and it was a little different than usual because they made this rule that the night officers had to stay on the campus they were assigned instead of floating between all of them. So we were on Busch and Livingston most of the night and it was funny because Officer Archibald was telling me how he just got back onto nights and was on day for a year. It was funny because I was going to do a day shift that Tuesday. So, I asked him what I should expect from the day shift and he told me it was a lot more belated things like theft and all the brass are their…

Medical Negligence Clinicians evaluate and treat multiple cases on a daily basis. While some cases are simple, other cases are very complex and demand an extensive evaluation, including detailed history taking, and meticulous examination. A case of a 38 year-old female with apparent symptoms of pneumonia was presented. The patient was obese and had initially presented to her primary care physician (PCP) with symptoms of an upper respiratory tract infection. She had been 8 weeks post-partum and had required two days of hospitalization after her delivery due to a severe hemorrhage.…

Criminal prosecution and prison time is becoming very common in the health care setting.. Avoiding negligent conduct in health care is easier said than done but determining the point when a conduct becomes criminal is also difficult. In my opinion, there should be criminal penalties for health care providers who perform negligent acts that result in the deformity or death of an individual. In 2011, Dr. Conray, Michael Jackson’s personal physician was charged for involuntary manslaughter in administering the anesthetic, propofol to Jackson that eventually led the death of Michael Jackson. He was convicted and sentence to four years in jail.…

After looking over the case study for the research paper and reading it several times slowly I am understanding the points of the case, however with some parts I am still a little confused. I have broken the parts down and also have highlighted words that I do not understand and plan to get an appropriate definition which will help me to understand the case study much more clearly, and if that does not help I will ask my group members and also you if I need any further clarification. For the research paper, I will use the CSUEB Library Database to conduct a search and look for peer-reviewed sources, and also other useful resources after I conduct a full search. Negligence, in law, is defined as the failure to use reasonable care, resulting in damage or injury to another. Every year in the United States, an average of 38 children die in the back of cars from hyperthermia. This negligence is considered involuntary manslaughter by the law, and deserves jail time. With a good enough lawyer, some of these guardians get supervised probation, and avoid jail time. Negligent guardians who leave the children they are responsible for in hot cars should be jailed because of the responsibility undertaken when caring for a child and the example it will set for future guardians to be more aware of their young ones.…
