The first opinion seems to be correct, but only when it comes to the cases of delinquency. However, in the cases of heinous crimes there is no excuse for the juveniles, and juveniles must be undoubtedly tried as adults. In general, it is quite obvious that juvenile offenders should be treated as adults. It will help to maintain social order and teach children about inadmissibility of any crime.…
As we all know juvenile cases get transferred to an adult court through a waiver. Usually, juvenile cases that are subject to waiver involves more serious crimes. However, there seems to be factors as to why juveniles with lesser offenses are being transferred to adult court. Such as, the juvenile might be older, they are a constant problem to the system and youth services has a hard time working with them and/or has to work with them for a long period of time, they may have a long criminal (non-violent) record of petty offenses, rehabilitation may have been unsuccessful and much more. I don’t agree with these rationales for a transfer.…
There is no reason why they should not be treated differently. It has been proven that crime committed by youth and crime committed by is drastically different. Adults have fully developed and a sixteen year old is not. A minor does not have the strength of an adult to commit a really dangerous crime. Therefore, juveniles should not be tried as adults because of the dangers an adult jail can do to a…
Juveniles should be convicted as adults for violent crimes because they are in the age that they can commit external crimes against people. It has jurisdiction of teens that are in the range of 13 to 17 years old that commit crimes. First off, in the article On Punishment and Teen Killers By Jennifer jenkins explains that most Juveniles convicted as a crime are repeat offenders. For the same reason if juveniles do not get the punishment they deserve they would most likely do it again. Teens are enrolled to know what they are doing and know what is good and what is bad.…
I don’t think juveniles should be placed in adult prison. It causes to many problems for younger kids to be surrounded by negative influences while they are still developing mentally and starting to mature. It causes problems with depression and making them think that some behavior is acceptable in a society outside of the prison when it isn’t. The depression leads to acting out which causes disciplinary actions that are to serve in prison than they would be in a juvenile facility.…
Adolescents need to know what results from their actions. Because of this, it is followed that juveniles should be tried as adults. If children want to act like adults and commit crimes, then they should be treated as adults and…
When it comes to the criminal justice system, there are many varying elements that contribute to the process through which accused offenders are counseled. As is expected, there are also numerous moral and ethical disputes that come with the territory, such as whether or not children, or 'juveniles', should be tried as adults in court for the violent crimes they commit. Some may say any child over the age of five should know the difference between right and wrong; for an individual to plan out a crime and act on it, the punishment should fit the offense, no matter the age. However, there is a thin line between vice and neurosis when it comes to juveniles. The incarceration of individuals under the age of sixteen at adult correctional facilities…
I also wondered should states lower the age at which juveniles can be tried as adults? Now I don’t know too much about the way the judicial system works and how we process criminals, but it has always fascinated me. I figured since the idea of prosecuting juveniles as adults can sometimes be a difficult subject, that I might as well start to look into it. I wanted to do some research and see what it takes to be tried as an adult, and if there are any rules…
And their characters are still in formation” (6). Throwing a juveniles in an adult prison despite committing an “adult” crime is similar to throwing a kitten into a cage of lions. There is a difference between a child and an adult. Adults have more life experience, their brain are more developed, their emotions can easily be controlled. A child on the other hand is underdeveloped, they learn from the adults around them.…
Most citizens possible think it’s not right to fully charge a minor in court as an adult, When others think otherwise , Reason for is that citizens believe that it violates the Eighth Amendment where that would be categorized as cruel and unusual punishment. It is believed by many that a minor is human being that is known as a young , not fully matured , and just loves to have fun, which for the most part is true. For Example , A minor’s brain doesn’t fully develop till the age 25, so if you were to think about a 15 year old teenager, that committed a murder that an adult would possibly commit an then get charged full life sentence but, remember that he wasn’t possibly not in the right state of mind because of some kind of illness or just wasn’t raised by a good family or some unexpected tragedy that had happen in his life that had impacted him in a very emotional or life time tragedy that no one is aware of.…
There have been many opinions on juveniles being convicted as adults on the crimes they have committed. When it comes to some of these harsh crimes, who could not punish the individual to the fullest? It does not matter how old a person is because everyone knows the difference between right and wrong. If someone is raised differently and believes it is okay to murder another human, than they cannot just change their mindset. An individual that makes and adult decision should have the same consequences.…
Children as young as nine years old are being tried as an adult in trial. Is it fair to hold these children and teens to the same mentality of adults? Children and teens should not be tried as adults, instead the judicial system should focus on…
People have different opinions on whether children should be charged as adults for their crimes. Some people think that juveniles need a second chance to be rehabilitated and become better members of society. That isn’t the case at times, not every person who commits a crime can change for the better. There are always chances of recidivism. That does mean that there isn’t hope for other juveniles who commit crimes to be rehabilitated.…
Juveniles should not be tried as adults for it is wrong to hold adolescents, under the legal age, to adult standards. If children do not even receive the same rights as adults in the first place, it makes no sense to try them in adult court. These juveniles should have the opportunity to be rehabilitated in a positive manner, for they tend to come from troubled households and violent neighborhoods. In over half of the cases these troubled kids don’t know any different way than a life of crime when surrounded by both social and environmental factors that influence their delinquent actions. One must commemorate that juveniles are mentally underdeveloped, and still have time to innovate if their issues are dealt with precisely and accurately.…
The decision of juveniles being tried as adults in the world of criminal justice has usually been an object of controversy. Some agree that an adolescent who commits a serious crime like murder deserves to be penalized exactly like an adult; while others declare that a minor should not face the same punishment as an adult. However, no matter how severe or appalling a crime may be, juveniles should not be tried as adults; the reason being that everyone should be granted the chance to learn from their mistakes. Juveniles should not be punished as adults, simply because they biologically distinct from adults. Teenagers are the midsection between children and adults.…
