Case Interview With Ms Rosen

On April 23, 2015 I interviewed Ms Rosen at the Panera Restaurant in Eureka, MO. Ms Rosen stated the following: As of this interview “things are still tough”. She said she experiences pain every day and has days where she can’t get out of bed without pain medication. Her current physician, Dr Jones has prescribed Hydrocodone, and Prednisone. She feels the combination of these two medications “keep me going”. I referred to Ms Rosen’s original complaint and statement summarizing it to her.

I told Ms Rosen, according to her and Kaar’s written statements, there was about a seven month period when she did not have contact with Kaar, then suddenly contacted him via Facebook with complaints of pain. I asked “when did the pain return?” According

Her shoulder immediately felt like it was “hanging” and continued to hurt so she put the sling back on. When she went in for her follow-up appointment, she told Kaar it hurt and felt like her shoulder was hanging out of the socket.

She said Kaar is a very tall man and remembers him standing over her, and looking down at her. He told her the sensation was normal and they’d take care of it. She was told she was being referred for physical therapy, but Kaar’s office took two months to set it up. She kept calling and talking to the office staff that she feels was unnecessarily rude to her. The staff kept giving her excuses about insurance problems before finally getting the issues resolved.

She started physical therapy, and feels she worked very hard. The therapist, “Carla” took measurements regularly to see if the muscle mass was increasing. Rosen was disappointed to learn she was making no gains. She returned to Kaar complaining of pain and talked to him about the lack of muscle mass and Kaar referred her for more physical

She met with Ms Garcia, General Counsel for Dr Kaar who told her they would try to reach some settlement. Rosen got a letter from Garcia saying they were dropping her as a patient.

Ms Rosen showed me her shoulder and told me she feels very self-conscious and keeps it covered. She also moves away from people trying to “hug” from that side as she’s embarrassed due to the obvious deformity (note: I attempted to take photos at Rosen’s request. Due to a phone malfunction I was not able to retain the photos from this visit. Photo’s seen in attachment # 4 were taken at a second meeting).

Ms Rosen says she also talked to Kaar about a Baker’s cyst on her knee. She went to the emergency room and was told she needed surgery. She remembers Kaar yelling at her, saying she was a liar, and the other doctor was a liar, she didn’t need surgery.

Ms Rosen feels Kaars office is a joke, his staff is a joke, and the outcome of her shoulder surgery should have been “cut and dry”. She feels Kaar’s treatment was inexcusable. She currently sees a Dr Burnstein at St Luke’s Hospital for rheumatoid
