CASE: Wilson v. Arkansas, 514 U.S. 927 (1995)
SUMMARY OF FACTS: The defendant (Wilson) had been selling drugs to a police informant in 1992. At one of the drug transactions, the defendant threatened to kill the informant with a gun if she had turned out to be working with law enforcement. The police later applied and obtained a warrant to search the defendant 's house and arrest both her and another defendant (Bryson Jacobs). The affidavits filed in support of the warrants had described in detail the narcotic transactions and the defendant 's (Jacobs) previous convictions of arson and firebombing. Upon arrival to the defendant 's house to conduct the search, the police officers found the main door to the home open. While opening an unlocked screen door and entering the home, the police identified themselves as law enforcement and stated they had a warrant. Once inside the household, the police had seized marijuana, methamphetamine, valium, paraphernalia, a gun, and ammunition and found the defendant in the bathroom attempting to flush some drugs down the toilet. The defendant (Wilson) and other defendant (Jacobs) were arrested and charged with possession and delivery of marijuana, delivery of methamphetamine, and possession of paraphernalia.
