In contrast to Kant’s point of view, Mill would suggest that since Holmes, Cruise, and their daughter are only three people and the number of photographers is much greater, that publishing these photos is ethical. These photographers have a job to take photos of celebrities—it is how they earn their living and put food on the table. Abstaining from doing what they are employed to do all to protect a mere three people, even if one of them is a child, does not match up with Mill’s philosophy. He advises that because the number of photographers is greater and publishing the photos would do them good, that they go ahead and continue doing so. This test requires the person striving to make the ethical decision to ask whether their decision meets five criterions, each criterion representing a letter. The criterions are as follows: Truthfulness, Authenticity, Respectfulness, Equity, and Social responsibility (Patterson & Wilkins, 2014). In this case, all five criterions of the T.A.R.E.S Test can be applied in one way or another. The first two criterions, Truthfulness and Authenticity, fall in favor of photographers publishing the photos because they are capturing moments that are just that—truthful and authentic. The photographs themselves are not fabricating anything—they are simply capturing a moment.
However, the next two criterions of Respectfulness and Equity go against the photographers publishing the photos because doing so could be considered disrespectful and, since the photos are being taken without Cruise, Holmes’ or their daughter’s knowledge, they are not on a level playing field and therefore lack a sense of
