The Ultimate Punishment
Although many people support capital punishment, I am a firm believer that nobody is entitled to take another person's life. Capital punishment has been dated back to the 18th century BC. The death penalty was also used in the 14th and seventh Century BC. In these centuries it was very easy to get punished with death. Death was the punishment for all crimes, including marrying a Jew, treason, or not confessing to a crime.
In the 18th century B.C. capital punishment was basically the only punishment available so many people died a year; today sentencing a criminal to death row is a more tedious process and not as inhumane. There were many ways to carry out the sentence …show more content…
In some states the judge must use the sentence given by the jury and in other states the judge can override the jury. Once convicted if the defendant believes the sentence was unfair the defendant can show the mistake was made by making an appeal. The next step consists of a petition to State trial court, appeal to stay highest Criminal Court, proportionality review, petition to US Supreme Court for right of certiorari. Federal habeas Corpus include petition to Federal District Court, evidentiary hearing, appeal to Federal Court of Appeals, en banc review, and other petition to US Supreme Court for writ of certiorari. After all of this, the case is taken to the pardon board, the pardon board will then give their thoughts on what should be done. It is the state's Governor, or the president's job to reduce the punishment given by the court or not. If the punishment is not reduced then the person sentenced to the death penalty must be put on death row. Death row, “an area of prison where those who have been sentenced to death are confined.” While on death row a paper signed by Governor or judge is sent out to give out the date of execution. Usually, what is done is the inmate is taken to a cell closer to the death chamber and kept on 24-hour suicide watch. However, they can’t harm anyone while in jail. Imprisoning someone for life also prevents an innocent person to die and of course it less cruel and less expensive. The death penalty is also in violation of the eighth amendment. The eighth amendment states that the government cannot use a cruel or unusual punishment. The government should strive to protect our every right and when a punishment is required they should use a fair and the least violent form of punishment. Finally, I believe that the government shouldn’t kill people because, “Why kill people that kill people to show killing people is wrong.” -Holly
