California Fair Pay Act Case Study

The California Fair Pay Act (SB358) is designed to provide strength to the state of California’s equal pay laws. It is supposed to accomplish this by eliminating loopholes that may prevent the effective enforcement of the law and by empowering employees with the ability to discuss pay rates without fear of workplace retaliation.

The new Act should help California to eliminate the gender wage gap with the following amendments to CA EPA:
• Employees performing substantially equivalent work are will be paid fairly by laying out requirements resulting in equal pay for work so long as employees are of “comparable character.”
• The outdated reference to the “same establishment” amongst the requirements for equal pay will be eliminated.
