Burt's Bees

I think she should move her business back to Maine. I know how “Burt’s Bees” has been successful in their business in their business, so the correct answer of could be already published, and it would be stay there (NC) and expand her into a global company. However, only based on the case information, I would rather back to Maine for several reasons if I were her. Firstly, there is no reason to take that huge risk of changing most their products. It could be a new start from the beginning. Even though Burt’s Bees and the personal care industry have a lot of potential than what they have now, all those judgements are based on their current products. If she has to change most of the products, she also has to start and decide everything from zero.

The main issue for this case is whether or not Dr. Baugh and Dr. Feldman’s noncompete agreements with Colombia Heart were in fact enforceable. Originally, on the trial court level, they agreed with the doctors in their suit against Colombia Heart, stating that the noncompete provision was unenforceable, and their actions were admissable. Colombia Heart brought it up on appeals. The case was ultimately reversed in their favor, as on appeal they disagreed and found that the noncompete agreements were actually enforceable, and that the doctors were in the wrong, and that they were not able to go and practice on their own due to the agreements they had as shareholders. I find this to be really interesting actually.…
