The 1980 court case, Armstrong V. Kline, drew from parents of children with exceptionalities becoming upset with the education system’s 180-day school year rule1. Beginning in January of 1980, they decided that enough was enough and they needed to do something before summer vacation came so, their child/children would not lose everything they learned during the school year1. The parents took on the court case, filing three class action lawsuits, all of which were against Caryl Kline, the secretary of education and chief official of the Department of Education1. The result of this particular case relieved me but, the fact it had to become a court case, I found to be absolutely ridiculous. Also, the terminology they used while describing the…

In my court case Witherwax v Transcare, Inc. 2005 NY. Transcare ambulance transported Witherwax to the hospital 2000, and the transcare employee didn’t recorded the right address for Witherwax resulting in Witherwax not receiving a bill for the services performed by transcare. Transcare sent witherwax bill to a collection agency. Witherwax claims that Paul Michael reported the debt to the three credit reporting agencies as being "seriously past due. Witherwax tried to resolve the debt, but learned that the invoice had been sent to an incorrect address: 30 West 61st Street, New York City, 10023, Apt.…
On Thursday, September 22nd at 4:00 p.m., I witnessed the Beebe v. Bozeman Deaconess Health Service, Inc. court case. The judge for this case was Judge Holly Brown. I walked into the court room while they were on recess, so I was a little confused about what was going on at first. It was interesting to be a part of the “please rise” standing ritual when the judge walked in. It makes a person wonder why the benches in the public’s seating area are so noisy, it seemed very disruptive.…
Pervear v. Massachusetts was a case over the issue of prisoners' rights brought to the United States Supreme Court in 1866. The Court was asked to rule on fines imposed upon a liquor dealer by the state. Pervear was licensed by the United States under the current internal revenue code to keep and sell liquor. He was fined and sentenced to three months of hard labor for failing to have a state license for his liquor store. He pleaded that he had a license from the United States under the internal revenue acts of Congress, he had paid a tax for the keeping and selling of intoxicating liquors, and that the fine and punishment imposed and inflicted by the law of Massachusetts was cruel, excessive, and unusual.…

The court defended that there is no law that refuses the professional freedom of physicians to compare problem-solving approaches to their counterparts in order to improve the quality of services they provide to the public. Dr. Ketcham’s affidavit concludes that he had no contact with Dr. Brock concerning the care or treatment of Oliver. He also noted that he was not aware of any contact between the Plaintiff and Dr. Brock while she was a patient at Bryan Whitfield Memorial Hospital. The supporting evidence mentioned above, lucidly supports Dr. Brock’s motion for summary judgment based on the adjudication of the…
While studying the case R. v Hauser, it is clear to see why it is known to be one of the leading constitutional decisions in understanding the workings of Peace, order and good governments in relation to a power struggle of jurisdiction. The whole case surrounds the question on whether the Attorney General, or the Attorney General of Canada should have the power to control the prosecution under the Federal Narcotics Control Act. It is a battle for powers of jurisdiction in regards to the criminal code, and more so the Narcotics Control Act; (NCA), 1961. The Narcotics Act was once Canada’s national drug control statue prior to its repeal in 1996 where the Controlled Drugs and Substance Act took its place. The NCA upheld an international treaty which prohibited the production, and supply of specific drugs; normally narcotics, unless given a licence for specific…
The handbook helped the panel hold the liability verdict against the weight of the evidence. The argument did not fall under any of the CEPA laws, therefore ruling in favor of Bridgeway, Inc (Hitesman v. Bridgeway Inc., 2014). In what way, if any, did the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 42 U.S.C.A. 1320d-1 to -9 impact the actions of Bridgeway? or impact the decision of the New Jersey Supreme Court? How does HIPAA apply to your analysis of the actions of the parties?…

When evaluating the organisation/ integration test the case of Cassidy v United Health (1951) is a case which in particular should be noted. In this case a patient had endured a terrible trauma. The patient had suffered due to the inattentive care the medical stuff at the NHS hospital had provided. The hospital involved tried to bypass the accusations and claimed they were not liable and accountable for any damage caused. The managers at the hospital claimed they could not be held accountable due to the fact the medical stuff were all highly trained.…
DRED SCOTT V. SANFORD: THE ROLE OF THE SUPREME COURT IN THE POLITICAL PROCESS Jay Barber 25938654 HIUS-221 November 16, 2017 As seminal decision rendered by the United States Supreme Court, Dred Scott v. Sanford brought the issues of racism and slavery to the forefront of American political culture during the nineteenth century. It has also been considered by legal and political scholars to be a “ghastly error”, the “product of an overly ideological and reactionary judge”, and a cause of the Civil War. Many abolitionists and Northerners declared the Supreme Court’s decision to be illegitimate while others demanded obedience to the Court’s decision and labeled disobedience as rebellion, treason, and unconstitutional.…
Should a doctor warn you if you have a certain amount of time left to live? A doctor doesn't have the choice to tell you whether you're about to die or you're not he has to tell you because of the oath he is under once people become doctors they have to take an oath called the Hippocratic oath this oath is a famous oath taken by all physicians and doctors if they don't tell you they could be facing a lawsuit by the family of the affected one cause the person that could of had a couple minutes to live could have called his family to say goodbye or to tell them how much he loved them or how badly he wanted to hear their voices before he went on to the next world just so he could die remembering he was loved ,in addition another problem from…
