I have mixed emotions on the Boy Scouts of America ruling of rather it was exercising its rights given to it by the First Amendment or rather it should not be allowed to exclude people based on the public accommodation exclusion in the first amendment. Considering the U.S. Supreme Court made up of lawyers could not agree, 5 to 4 decision, I am sure that it is beyond my ability to determine legally where BSA falls into this definition. My biggest objection to the BSA ruling is that it did not specifically have rules that applied to homosexuality; it was very vague and told its leaders not to discuss these issues. It is also a huge organization even though it is private and does not receive any government funds, it can based on its size, have an influence on people with the decisions it makes, and the …show more content…
In this sense, it is in the public realm, like a politician who is a private citizen but then throws himself into the public eye by running for a particular office. Once in the public realm it must answer for its actions. In the case with the cake baker, I lean towards the private owner of a business’s rights. Our country, established by many people who wanted individual rights to freedom of religion, is made of all kinds of opinions and beliefs, and it is not our right to tell them what or how they should believe. We can all agree to disagree when it comes to our own personal beliefs. As long as we do not use our belief to cause physical harm or incite a riot, it is just that, our belief, and we have a right to it. When we stop allowing this, we lose our rights as individuals, and it becomes a totalitarian government. As individuals we have the right to not shop were we disagree with the beliefs of the owner, so the owner has the same right to not serve someone or provide something for someone that goes against their beliefs. These private owners are not in the public accommodations
